MEMBERSHIP TERMS AND CONDITIONS

DESCRIPTION OF MEMBERSHIP: Membership is provided by LuxéVegas, a dba of LuxéMont. Membership shall remain valid so long as the annual membership fees are paid, the use of any credit extended to member has been paid in a timely fashion and the personal and financial information provided by the member is factual and correct. Incorrect or misleading information that results in LuxéVegas denying financing may result in the forfeiture of any membership refunds due member at the discretion of LuxéVegas. Membership is available to US residents only, who agree to the terms and conditions of membership, qualifies with a combined household income of over $40,000 annually, has a valid credit or debit card account, is over 21 years of age, has proof of income for a minimum of six consecutive months and has paid the necessary fees for enrollment.

MEMBERSHIP FEES: The annual membership fees of $10.75 a month (paid one time annually) can be paid as indicated on the join form. All card members agree to have their account of record automatically electronically charged to a credit or debit card for membership fees upon acceptance of these terms and as listed on the order form, and prior to financing approval on any product or service. If for any reason you are not fully satisfied with your membership we offer a complete 30 day money back guarantee. Simply call our toll-free customer service number printed in your membership materials, members Web site, or listed on the "confirmation page" of this site and you will not be charged anything further. Your refund will be prorated on any unused portion of your membership.

MEMBERSHIP TERMS AND CONDITIONS

CONCIERGE SERVICE CREDIT PROGRAM: The Concierge Service Credits program ("CSC Program"), membership and its benefits are offered at the sole discretion of LuxeVegas.com. The rights and obligations under the CSC Program may be assigned or transferred by LuxeVegas to any other related or unrelated entity at any time, and performance thereafter shall be the responsibility of that entity.

1.   Program Sponsor: The CSC Program is operated and administered by LuxeVegas.com.

2.   Participation Eligibility:
Participation in the CSC Program is available to individuals (“you”) as stated in these Terms and Conditions. You may maintain only one account. Companies and/or other entities cannot enroll without written permission from LuxeVegas, and the membership is non-transferable to another person for any other reason, including divorce or inheritance.

3.   CSC Program Usage: Members may use Concierge Service Credits for black car transportation to or from Hotel and Airport, VIP Nightclub walk-in, or to offset portions of cabaña or bottle services. Guests may accompany member, but are responsible for any appropriate fees and tips necessary for premier bottle and/or table service or to escort guests through the VIP line etc…

Appropriate fees and tips not covered by Concierge Service Credits are the responsibility of the member and member may be required to pre-pay LuxéVegas or our concierge host before the service is rendered. In some cases, and depending on the activity, a deposit may be required for the non-Concierge Service Credits portion of an activity before an actual reservation is made. In most cases, pricing will be quoted prior to meeting member at the specific nightclub and will vary depending on the specific club, time of day or day of the week. Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times. LuxéVegas does not mark up nightclub fees or tips. Compensation to LuxéVegas is based on time spent and will be quoted separately. Most black car transportation service allows up to four passengers without additional fees; members or their guests are responsible for any additional fees.

Tips for LuxéVegas concierge are not included, are encouraged and greatly appreciated.

4.   CSC Program Availability: LuxeVegas reserves the right to restrict, suspend, discontinue or cancel this CSC Program upon 90 day written notice to all active members. In that event, your right to receive Concierge Service Credits may end 30 days after we notify you, and your right to redeem Concierge Service Credits may end 90 days after we notify you, no matter what the level of your participation in the CSC Program. Concierge Service Credits for all members not presented for redemption on or before such redemption end date cannot be redeemed.

5.   CSC Program Cancellation: LuxeVegas reserves the right to cancel any portion of the CSC Program and revoke any and all unredeemed Concierge Service Credits collected by any member for reasons that include, but are not limited to: 1) violation of these Terms and Conditions; 2) misrepresentation of any information or any misuse of this Program; 3) violation of any national, state or local law or regulation in connection with the use of membership privileges; 4) failure to pay membership fee, finance fees if financing vacation or partner Hotel, Car rental, show tickets or similar charges; 5) a check or credit card payment to LuxeVegas of participating hotel partner that is returned for insufficient funds or is invalid for any reason; 6) commission of fraud or abuse involving any portion of this Program; 7) more than one active account per member; or 8) action, in any other way, to the detriment of the Program or any of its alliances; all as may be determined by LuxeVegas in its sole discretion.

6.   Accumulating Concierge Service Credits and Maximum Balance: Accumulating Concierge Service Credits and Maximum Balance: You may earn Concierge Service Credits when joining Club LuxeVegas, at annual membership renewal dates and when booking select travel packages from LuxeVegas directly. Concierge Service Credits will not be earned for stays made prior to the date of your enrollment as shown in our records. A stay is defined as consecutive nights at the same qualifying resort, regardless of frequency of check-in/check-out.

Member receives $100 Concierge Service Credits at the time of initial membership activation and at each annual anniversary date. In addition, members receive $100 Concierge Service Credits for purchasing a two (2) or three (3) night stay; and $200 for purchasing stays for four (4) nights or greater at select hotels. Member can earn up to a maximum of $300 Concierge Service Credits annually and only carry a maximum balance of $600 in unused Concierge Service Credits at any given time. Unused Concierge Service Credits over $600 will be deleted from the account and cannot be reinstated. Concierge Service Credits can only be used in $100 increments, and no more than $100 in Concierge Service Credits can be used for any single activity.

7.   Limits on Concierge Service Credits for Stays: Concierge Service Credits are not earned for stays that were not purchased through LuxeVegas, or for non-qualifying hotels, the following reduced room rates (“Non-Qualifying Room Rates”; “Non-Qualifying Stay”): net wholesale individual and group rate, package rate, employee discount rate, crew rate, seasonal worker/crew rate, 50% travel club discount rate, industry discount rate, distressed passenger rate, Priority Club Reward Nights/Airline Hotel Reward rate, most rates booked through most third party web sites,  complimentary hotel stays or any other rates not defined as a Qualifying Room Rate. Program can not be combined with other Club LuxeVegas programs, Concierge Service Credits are not earned for stays if member chooses to utilize LuxeVegas’s 5% cash rebate program for the stay.

8.   Concierge Service Credits have no value: Concierge Service Credits are not redeemable for cash or any other form of credit and have no value until presented for redemption in accordance with the terms and conditions of this Program. Concierge Service Credits have no fixed or ascertainable cash value. Members have no ownership interest in accrued points and accrued points do not constitute property of the members. Use of the word "earn" in marketing materials in relation to Concierge Service Credits shall mean "collect" and shall not infer that the Concierge Service Credits have any value until they are presented for redemption. Concierge Service Credits may not be purchased or sold and are not transferable except as otherwise stated herein.

9.   Communications Not Received: LuxeVegas is not liable for loss of misdirected correspondence, requests, freight, or Reward Certificates that may be incomplete, illegal, delayed, lost or stolen.

REWARD ORDER PROCEDURES:  Member can redeem your Concierge Service Credits for rewards by calling the Service Center at 1.800.984.1898. Member must have the required number of Concierge Service Credits in your account prior to redeeming points for a reward.  Information containing specific product/service details, warranties and any restrictions are available for selected merchandise by calling the Service Center. It is important to check this information prior to redeeming your reward. Certain restrictions may apply (particularly on travel-related rewards), such as blackout dates, day-of-week usage, seating or room availability/allocation, participating locations, expiration dates and other factors that may affect your use of the reward.

Appropriate fees and tips necessary to be escorted through the VIP line, premier bottle and/or table service is the responsibility of the member and their guests. Members may be required to pre-pay LuxéVegas or our concierge host before entering the club. In some cases members may be required to pay the nightclub directly and then pay LuxéVegas concierge separately for LuxéVegas related services. In most cases pricing will be quoted prior to meeting member at the specific nightclub and will vary depending on the specific club, time of day and day of the week. Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times. LuxéVegas does not mark up nightclubs fees or tips, compensation to LuxéVegas is based on time spent and will be quoted separately. Tips for LuxéVegas concierge are not included and are encouraged and greatly appreciated.

Global Elite Personal Concierge Service: Club LuxéVegas offers the Global Elite Personal Concierge Service to enhance your Las Vegas experience. We use an innovative combination of technology and local live human assistance to help our clients during their stay. We reserve the right to change arrangements both before and after a booking has been confirmed. We will notify you of any changes as soon as we are notified of them but we cannot accept any liability in relation to any change.Club LuxéVegas does not markup ticket prices or vendor fees. Compensation for our personal face-to-face concierge service is based on time spent organizing and implementing services and will be quoted separately. Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times.
Tips for LuxéVegas concierge are not included and are encouraged and greatly appreciated.

TRAVEL REWARDS PROGRAM

Members receive a 5% cash rebate for member and guest(s) travel that is booked through the LuxeVegas travel department. Only bookings reserved with one credit card and online through our website or on the phone with our travel concierge qualify for rebate. LuxeVegas will mail you rebate check after we will receive confirmation from hotel that your trip was completed, usually it takes 3 weeks after the trip, if you cancel your trip or the  trip is cancelled by any reason, member is not eligible for rebate.

Rebate check is issued on the name of the member related to the reservation.

REBATE AMOUNTS:

Rebate for the land portion of land only or air and land package - 5% of hotel room rate only - excludes fees, taxes or other incidental room charges or fees.
Airline Tickets:

*Charter flight: 5% of base rate only

*Contracted fare tickets of scheduled airlines: 5% of airfare only

*Published fare tickets of scheduled Airlines are not applicable for Rebate.

Rebate is paid on the itinerary price excluding air taxes, port charges, government taxes, gratitude fees, excursions, segment fees, government-imposed surcharges, security and departure taxes, select instances of pre-collected hotel airline or cruise line service fees, paid facilities of hotel airline or cruise line, any items of a personal nature including but not limited to: phone calls, fuel, tips, laundry, beverages, meals not stated, taxi and bus fares, passport and visa fees.

LuxeVegas reserves the right to modify rebate percentage or discontinue the rebate program at any time without prior notice.

*Contracted fare: A fare available when a vendor (wholesaler company) buys a block of airline seats to sell to customers. The vendor (wholesaler company) controls pricing rather than the airline.

*Published fare - Published fare tickets are not applicable for rebate. Fare listed in the airline carrier's schedule of prices. The airline controls the prices.

*Charter: A trip or the act in which a company hires all or part of an airplane or other transportation for resale to the public or a specified group.

PURCHASED TRAVEL SERVICE

The following general terms and conditions apply, however regional circumstances and regulations, contractual obligations to suppliers, and matters relating to location, product type and supply logistics may cause these to be varied slightly for specific products, or specific destinations. These amendments and alterations are shown in the Terms And Conditions sections of each Web site, and should be read in conjunction with the Terms And Conditions shown below.

Bookings of $1,000 or less, or bookings made within 30 days will be required to pay the full amount at the time of confirmation. Bookings more than $1,000 or made more than 30 days out will be required to pay a deposit of 15% at the time of confirmation. Deposit conditions for certain accommodations, high travel periods and tour products may vary, and member will be notified at time of booking.

Bookings made less than 30 days prior to travel: Bookings made within 30 days of travel must be paid in full by credit card at the time of booking.

Final Payment: Final payment is due 30 days prior to travel date. No vouchers will be issued until final payment is received in our office. Final payment conditions for certain accommodation, high travel periods and tour products may vary, and member will be notified at time of booking.

CANCELLATION: You, or a guest of your party, may cancel your travel arrangements at any time. A written notification from the person who signed the reservation form must be received at our office prior to us canceling your travel arrangement. Applicable cancellation charges up to the maximum amount is assessed as follows:

Period before departure within which written cancellation is received amount of cancellation charge shown as a % of holiday price:

More than 90 Days- $100 plus other applicable fees

Between 46- 89 Days- the amount of the deposit

Between 30-45 Days- 25% of the total cost of the travel arrangement

Between 15-29 Days- 50% of the total cost of the travel arrangement

Less than 14 Days- 100% of the total cost of the travel arrangement

For certain hotels, flights, entertainment packages and tours etc., the cancellation may be higher. Please contact us for details. Depending on the reason for cancellation, you may be able to reclaim these cancellation fees less any excesses under the terms of your insurance policy. Cancellation charges must however be paid before they can be claimed from insurers. Please note that some airline tickets have a 100% nonrefundable fee.

Cancellations must be in writing and should be addressed to the consultant handling the booking.

Rate Increase and blackout dates:

Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times.

TRAVEL FINANCING SERVICE

TRAVEL FINANCING: Is available up to 80% on select air, hotel, resort and vacation packages listed in our membership materials. A deposit from 20% to 30% is required at the time your travel request is sent. The vacations to choose from include one to three night stays for two people traveling together on the same itinerary and sharing one room with the exception being our land-only Condominium Resort packages which feature one to three bedrooms. Rate increases and black out dates may apply due to conventions, holidays and other heavily trafficked times. LuxéVegas reserve the right to change the terms and conditions of membership and/or materials at any time. Rates and destinations are subject to change without notice.

The amount of credit extended to the member shall not exceed $5,000 at any given time and no more than $2,500 can be financed during one specific trip. The amount of credit issued is based on the pre-configured packages purchased as listed in our materials and calculating the remaining balance after deducting the down payment. The Credit limit is not intended to be used like a normal credit card. The credit limit allows a member to make payments on an initial first time purchase, create six months of good payment history, then using the remaining balance for financing on future additional products or travel services.

Usage of the member financing is only available to the member listed on the account of record. You agree that you will use LuxéVegas only for your own behalf and no more than one guest. LuxéVegas reserves the right to ask for additional deposits if your membership or repayment history reflects negative activity. Any fees or product payment returned to us NSF or un-paid for any reason may disqualify you from any future financing.

Insurance:
We strongly recommend that you purchase a comprehensive travel protection plan both for protection against emergencies which may occur, and for your own peace of mind. We can offer excellent travel protection plans, details of which are available on request.

RETURNED, NSF ACH PAYMENTS AND OVER THE LIMIT PAYMENTS:
In the event that your enrollment fee is returned due to over the limit reasons, LuxéVegas may immediately attempt to collect the amount by presenting the credit card charge a second time or third time to your original banking institution. Any member with negative payment history maybe subject to a higher deposit on any future financed travel or services.

CANCELLATION POLICY:
You can cancel within 30 days to stop all future fees and receive a full refund on moneys collected. If you cancel after 30 days any refund will be prorated and a refund will be issued based on the unused portion of your enrollment fee. The monthly maintenance fee is not refunded but will be stopped immediately upon cancellation. Please be aware that e-mails sent to LuxéVegas are not answered by a live representative and will not be accepted as a valid form of canceling your membership. Any cancellation must be made with a live representative on the phone or in writing. ANY PERSON(s) who have used the finance option of this membership may not cancel their membership during any period of a year for which payments are being made. The Customer Service phone number that is located on our member Web site is available Monday - Friday 9 a.m. - 5 p.m. (PST) or you may write us at Club LuxeVegas Member Service, 501 West Broadway, Plaza A, Suite 321 San Diego, CA 92101.

NOTICE OF CHANGES:
Any such changes will be shown in these Terms and Conditions on the LuxeVegas.com membership web site and will be effective immediately unless stated otherwise. A notice that a change has been made will be placed on the web site for a reasonable period of time. Any changes to any printed version of the Terms and Conditions will be contained in the next reprinting of that printed version. LuxeVegas will attempt to notify active members of major Program changes, but will not be liable for failure to do so, and all members will nevertheless be bound.

MEMBERSHIP TERMS: Your membership is effective for a period of 12 months following enrollment date under the annual membership plan. Each year you will be notified by mail 30 days prior to the renewal date. This is known as a Continuity Plan. We reserve the right to increase or decrease the membership fee for each new memberhip term.

FINANCE PAYMENTS: Financing is issued on select travel and services to Members who agree to have their checking accounts, credit or debit card debited for repayment of the credit extended on a monthly basis as listed in our membership materials. Payment terms range from 3 to 18 months depending on the selected product or service. A separate promise to pay agreement between LuxéVegas and the member will be sent for signature for each item financed by the member.

CREDIT BUREAU REPORTING: I understand that the company is a subscriber to a Credit Bureau(s) and that my new account as well as my monthly payment history will be reported to the Credit Bureau(s). The company reserves the right to not report your account to any credit bureau.

DEFAULT ON ACCOUNT: I will be in default if: a) I fail to pay the "monthly payment" when due; or b) I breach any of the Terms and Conditions of the Purchase Agreement. If I am in default, then upon compliance with applicable law, LuxéVegas has the right to: a) demand me to pay the entire unpaid balance on the account immediately; b) apply monies received on subsequent purchases to any delinquent account balance owed including late fees if applicable; and/or c) proceed with legal action.

DELINQUENT ACCOUNT: My account is considered delinquent if the Monthly Payment is not received by LuxéVegas by the due date. If this occurs, a $15 late fee may be charged to my account.

IDENTITY PROTECTION: All members financing any travel or services may be required to provide to our finance department the following documentation for Identity, Residence and Employment verification purposes only: 1. Photocopy of valid state issued driver's license or identification card. 2. Photocopy of your federally issued social security card. 3. Photocopy of a current utility bill in your name and showing your current address. 4. Photocopy of a current pay stub in your name and showing a minimum of 6 months of employment.

Our underwriting department reserves the right to require the submittal of any additional forms of identification and or residential and employment documentation not stated here that it deems necessary to satisfy the above stated requirements for loan approval. If the documentation sent by you fails to satisfy these requirements to our satisfaction we reserve the right to refuse financing to anyone at anytime. The above requirements are meant to protect you the member and us against identity theft and fraud.

SECURITY INTEREST: LuxéVegas, to the extent legally permissible, retains a security interest in all merchandise charged on your account until the balance is paid in full.

LEGAL RIGHTS: Neither the Program nor any benefit offered by the Program creates, constitutes or gives rise to any legal or contractual rights by members against LuxeVegas or it’s parent company.

RESPONSIBILITY AND LIABILITY: LuxéVegas, (a dba acting through its parent company LuxeMont, Inc.) shall have no liability in regard to any services provided by any vendor. You agree that any claim with regard to transportation and travel services shall be made against the vendor of such services and not LuxéVegas; LuxéVegas's sole obligation hereunder shall be to forward to the vendor all payments for services ordered and forward to you all the necessary travel documents. The hotels, ground and air carriers, and other travel providers which supply services in connection with these vacations are independent contractors and are not agents of LuxéVegas. All coupons, receipts, passes, and tickets issued by hotels, carriers and other suppliers are issued on the terms and conditions specified by the suppliers. LuxéVegas does not have the authority to alter those terms. LuxéVegas is not responsible for personal injuries, loss or damage of property, inconvenience or expense resulting from matters beyond its control, such as, acts of terrorism, defects in vehicles, breakdowns in equipment, government actions, strikes, theft, changes in itinerary or schedules, inclement weather and acts of God. LuxéVegas may, in its sole judgment, make any changes and cancellations to vacation programs and schedules that it believes necessary. Individual programs and travel benefits within the LuxéVegas membership program may be subject to separate terms and conditions and may be altered or substituted with products or services of equal or better value without prior notice to a member.
NEITHER LUXÉVEGAS NOR ANY OF ITS INFORMATION PROVIDERS, PARENTS, MEMBERS, SUBSIDIARIES, AFFILIATES, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT; OR RESULTING FROM THE USE OR THE INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO: DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE DAMAGES, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

STATE NOTICES

NOTICE FOR CALIFORNIA RESIDENTS: California law requires that we inform customers that should they fail to fulfill the terms of their credit obligation, a negative report reflecting on their credit record may be submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.

NOTICE FOR FLORIDA RESIDENTS: You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.

NOTICE FOR OHIO RESIDENTS: The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

NOTICE FOR MARRIED WISCONSIN RESIDENTS: No Agreement, unilateral statement or court decree relating to marital property adversely affects a creditor's interest, unless prior to the time credit is granted the creditor is furnished a copy of the Agreement, statement or decree, or has actual knowledge of the adverse position.

SELLER OF TRAVEL

All paid and financed travel service is provided by LuxéVegas' parent company, Player Vacation Club a registered seller of travel in California, Seller of Travel #: 206 2860-40. California law requires certain sellers of travel to have a trust account or bond. Players Vacation Club has a trust account. Registration as a seller of travel does not constitute approval by the State of California Players Vacation Club Inc. is registered with the state of Florida as a Seller of Travel.
